The history of Proposition 8 stems from last year’s court decision that overturned a state law limiting marriage to opposite-sex couples. In November 2008, that ruling was challenged by voters when Proposition 8 went to the ballot, offering an amendment to the California Constitution that would ban same-sex marriage.
Between the months of May and November 2008 almost 18,000 gay couples were able to marry. In their ruling today, California’s high court will protect those marriages. But moving forward same-sex couples can no longer marry in CA.
There is a ray of hope: According to a recent Center for American Progress study, 58% of young voters support gay marriage. And just through generational growth, by 2018 the majority of Americans will agree.

I am a young political activist who also happens to be conservative. My views on same-sex marriage have less to do with morals, love etc and more to do with law. I take a more ‘Ron Paul’ view on the subject. Don’t get me wrong, as a conservative I believe in freedom. That is what conservatism is based on…freedom and the protection of inalienable rights for the individual. Liberalism is based on equality at the expense of freedom; and in the end you get no freedom and no equality. Most liberal programs ‘sound good.’ Who doesn’t want to give homes to everyone? But in reality it doesn’t work. Just look at the Soviet Union.
Anyway, the first major issue I have with same-sex marriage is redefining words and marriage is a word with a specific definition. The law is based on words having meaning. If you begin to re-define this word why not redefine other words, like freedom or republic. Same-sex couples can get the same rights as opposite sex couples in a civil union.
Secondly, what isn’t a marriage? If we are going down this path we have to figure out what is a marriage and what is not. Could a mother and son get married? Can cousins get married? Can a man marry his cat? Polygamy?
All of these must be addressed.
Thirdly, and the more libertarian argument…why have marriage be sanctioned by the state at all. Could agreements regarding children, assets etc just be contracts or LLCs? Remember that the institution of marriage is not about ‘love.’It is a contract put into place for the protection of assets and children.
Fourthly, Proposition 8, as stated above, had nothing to do with same-sex marriage. It was about judicial activism. I do not believe that an activist judge can take the liberty to overturn a majority vote because they do not think its ‘fair.’ I think a lot of liberal policies; welfare, social security etc are both unfair and unconstitutional but I understand that I must go through legal steps to abolish them.
I urge you to please give the full picture on any issue that ‘Rock The Vote’ presents to a young and impressionable audience. I have noticed that your organization continues to push emotional hot buttons and taps into the naivety and the idealism of the youth. Freedom is a wonderful issue to get behind especially now that the state is getting more and more power and taxes are rising etc etc. Perhaps this is a rebellious issue this organization can get behind. I know that it will not because this is a “conservative/libertarian” message and although Rock the Vote is “neutral” freedom is not the ‘ray of hope’ this organization is looking for.
